Esprit Film and Television Limited points out that, as its charges are not proportionate to the value of the equipment or the total sums of money involved in the work on which its customers are engaged, Esprit Film and Television Limited shall not be liable for any loss or damage of any kind whether consequential or otherwise, whether caused by negligence or otherwise resulting from any delay, detention, late delivery, non delivery or deficiency in the equipment. 

The customer shall take good care of the equipment, and ensure that it is used in a skillful and proper manner by having the necessary training and experience in operating the equipment. The customer must ensure that all equipment must be operated safely by suitably qualified operators at all times within relevant legislation for the operation of the equipment. Customers must not try to repair, adjust or otherwise interfere with the equipment except insofar as it is necessary for its proper use. 

Customers hiring Radio Microphone equipment shall ensure that they hold a license to operate the radio microphone equipment in the country of operation and as a condition of hire and warrant that a license is in place for legal operation of the equipment. The customer shall take full responsibility for the safe and proper operation of equipment at all times. Esprit Film and Television Limited shall not be liable for any damage or injury of any kind whether consequential or otherwise, whether caused by negligence or otherwise or deficiency in the equipment. We strongly advise customers to fully insure the operation of the equipment for its safe and proper use. 

Equipment shall be returned in a clean state: a cleaning charge shall be made for equipment returned in an excessively dirty state. 

The customer shall be responsible for all loss and damage to the equipment from the time of collection by, (or delivery to) the customer until it is returned to (or collected by) Esprit Film and Television Limited. It is a requirement of hire that the customer fully insures the equipment for its full replacement value if lost, stolen or damaged. how so ever caused. The customer is also responsible for any loss of hire or revenue to Esprit Film and Television Limited if equipment is lost damaged, stolen or other wise rendered inoperable howsoever caused until repair or replacement can be effected. Esprit retain the right to repair or replace equipment on an as new like for like basis at their reasonable discretion if equipment is lost or damaged, stolen or rendered inoperable. We strongly advise customers to insure the equipment for loss of hire by Esprit Film and Television Limited until equipment is replaced or repaired. 

Customers hiring Diving breathing apparatus and underwater communications systems warrant it will be used in accordance with Manufacturers requirements and instructions and are suitably qualified to use and operate the equipment, including operation of the equipment in the country of operations Diving regulations. The customer shall take full responsibility for the safe and proper operation of equipment at all times. Esprit Film and Television Limited shall not be liable for any damage or injury of any kind whether consequential or otherwise, whether caused by negligence or otherwise or deficiency in the equipment. We strongly advise customers to fully insure the operation of the equipment for its safe and proper use. 

One day’s hire period is defined as midnight to midnight. A week is any period of seven days. Collections should be made after 14.00hrs on the day prior to the hire of equipment. Returning of equipment should be made before 11.00hrs on the day after completion of the hire period, without incurring any extra hire charge. 

Any identifications marking or label MUST NOT be removed or covered. 

The customer must inform Esprit Film and Television Limited at the earliest possible opportunity of any intention to retain the equipment for a longer period than was originally booked. In the event of the equipment not being available for the extra period, it should be returned on the original agreed date or other such date as agreed in writing with Esprit Film and Television Limited. 

Media Transfers, compositions and data created resulting from work undertaken or by use of equipment provided by Esprit Film and Television Limited remain the property of Esprit Film and Television Limited until all sums are paid for in full. 

All goods purchased by the customer remain the property of Esprit Film and Television Limited until all sums are paid for in full. 

The customer shall grant full and unhindered rights of access to Esprit Film and Television Limited or its agents to inspect or uplift its property, data or media at any time. 

The customer undertakes not reverse engineer, copy or replicate any custom built equipment or specialist process hired or made known to the client by Esprit.

Provisional bookings are only accepted on the understanding that they do not guarantee availability of equipment. 

Esprit Film and Television Limited reserve the right to impose a cancellation charge equivalent to 100% of one day’s hire for any booking cancelled at less than 24 hours notice and 50% of one day’s hire for any booking cancelled at less than 48 hours notice. 

Esprit Film and Television Limited will use its best endeavors to accommodate any over run of the agreed return date and extend the hire of equipment to the customer. Esprit Film and Television Limited reserve the right recharge on an ongoing basis any equipment it needs to cross hire to accommodate other clients hire bookings caused by non return of the hired equipment by its due return date or equipment that is returned damaged or in an unserviceable condition. 

The customer shall make payment within 30 days of the date of the invoice. Esprit reserve the right to charge interest for late payment of invoices at 8% per month (Commercial debts Interest Act 1998)
